This document waives and releases lien, stop payment notice, and payment bond rights the claimant has for labor and service provided, and equipment and material delivered, to the customer on this job. Rights based upon a payment bond that specifically references this document may not be waived.

Upon receipt by the undersigned of a check from ________________ in the sum of $0.00 payable to ________________, and when the check has been properly endorsed and has been paid by the bank upon which it is drawn, this document becomes effective to release any mechanic's lien, stop payment notice, or payment bond right the claimant has on the job located at ________________ to the following extent.

This release covers a progress payment for all labor, services, equipment, or material furnished to the customer or to the property through ________________ only, and does not cover any retention retained before or after the release date; extras for which the claimant has not received payment; or items furnished after that date.

What types of lien waiver can I create?

Conditional or unconditional — which should I use?

Use a conditional waiver when you have not yet been paid: it only takes effect once the payment clears, so you are protected if the check bounces or never arrives. Use an unconditional waiver only after you have actually received and cleared the payment, because it releases your lien rights immediately whether or not you have been paid.

Are these the official statutory forms for my state?

These are general-purpose templates modeled on widely-used statutory wording. California prescribes specific statutory language (Civil Code §§ 8132–8138) and the California output follows it.
